1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of websites, e-commerce platforms, mobile applications, and other services (collectively, the "Live4 Wellness Services") operated by or on behalf of Live4 Wellness Inc. ("Live4 Wellness," "we," "our," or "us"). These Terms are a legal agreement between you and Live4 Wellness and affect your legal rights. Please read them carefully.

By accessing or using any part of the Live4 Wellness Services, including purchasing our products, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you are not permitted to use our Services.

By using our Services, you represent that you are legally eligible to form a binding contract. 3. Products, Content, and Health Information Disclaimer

All products sold through Live4 Wellness are based on clean-label, whole food principles. However, we make no guarantees regarding outcomes. Our products are not intended to diagnose, treat, cure, or prevent any disease.

The content on our website, blog, or any materials provided by us is for informational purposes only and should not be considered a substitute for professional medical advice. Always consult with your physician or qualified health professional before consuming any wellness product.

4. Orders, Payment, and Billing

All purchases are subject to product availability and confirmation of the order price. We reserve the right to refuse or cancel any order at our sole discretion.

You agree to provide current, complete, and accurate purchase and account information. You authorize Live4 Wellness (and any authorized payment processors) to charge the payment method provided for your purchase.

All prices are listed in Canadian Dollars (CAD) unless otherwise stated. Taxes, shipping, and handling fees are added at checkout.

We reserve the right to limit quantities purchased per person, household, or order and may cancel orders that violate these limits.

5. Shipping, Risk of Loss, and Title

We aim to process and ship orders promptly, but delivery times are not guaranteed. Shipping costs and timelines are provided at checkout.

All risk of loss passes to you upon delivery of the order to the shipping carrier. Title and ownership of products are transferred to you once the item is shipped.

We are not liable for shipping delays caused by carriers, weather, customs clearance, or other circumstances beyond our control.

6. Eligibility

You must be at least 18 years of age (or the age of majority in your province, territory, state or jurisdiction of residence) to use the Services. By using our Services, you represent and warrant that:

You have the legal authority to enter into these Terms;
Any information you provide is accurate and complete;
You will use the Services in compliance with these Terms and applicable laws.

7. Returns, Refunds, and Exchanges

Please refer to our Return & Refund Policy for full details. In summary:

Only unopened, unused products in original packaging may be returned within 30 days of delivery;
You must provide proof of purchase;
Refunds are issued to the original payment method upon inspection and approval;
Shipping fees are non-refundable unless due to our error;
Products marked final sale or promotional items may not be eligible for return.

Live4 Wellness reserves the right to refuse returns or issue partial refunds at our sole discretion.

8. Ownership and Intellectual Property

All trademarks, logos, product packaging, design elements, content, graphics, images, videos, and text appearing on or through the Services are owned or licensed by Live4 Wellness. These materials are protected under copyright, trademark, and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial purposes only. You agree not to:

Reproduce, duplicate, copy, sell, or resell any part of the Services;
Use any robot, crawler, scraper, or automated means to access our Services;
Modify, adapt, reverse-engineer, or create derivative works based on our content or systems.

Any unauthorized use will terminate the license granted and may violate applicable laws.

9. User Content and Submissions

You may submit reviews, comments, testimonials, photos, or other content ("User Content"). You retain ownership of your User Content, but by posting or submitting it, you grant Live4 Wellness a perpetual, royalty-free, worldwide, transferable, and sublicensable license to use, display, publish, modify, adapt, and distribute the content for promotional and operational purposes.

You agree not to post User Content that is unlawful, defamatory, threatening, obscene, infringing, or otherwise objectionable. We reserve the right to remove any content at our discretion.

10. Restrictions on Use

You agree not to:

Use the Services for unlawful or unauthorized purposes;
Impersonate any person or entity;
Attempt to reverse engineer, decompile, or exploit any aspect of our Services;
Transmit any malware, viruses, or malicious code;
Harvest or collect user information without consent.

All orders are subject to acceptance and availability. We reserve the right to cancel or limit quantities at our discretion.

Prices are listed in CAD and are subject to change without notice.
Taxes and shipping charges will be calculated at checkout.
We accept payment through secure third-party payment processors. You agree to pay all charges incurred by you or your payment method.

16. Shipping & Risk of Loss

Ownership of products passes to you upon shipment. We are not responsible for delays, losses, or damage during shipping. Please see our Shipping Policy for more details.

17. Returns & Refunds

Please refer to our full Return & Refund Policy. In brief:

Unopened, unused products may be returned within 30 days.
We do not accept returns of opened consumable products.
Refunds (if approved) will be issued to the original method of payment.
Shipping costs are non-refundable unless the return is due to our error.

18. Disclaimers & Limitation of Liability

THE SERVICES AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

To the fullest extent permitted by law:

We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Services, products, or reliance on any content.
We do not warrant that the Services will be uninterrupted, error-free, secure, or free of viruses. You assume all responsibility and risk for your use of the Services.

Some jurisdictions may not allow certain exclusions or limitations, so these may not apply to you.

19. Limitation of Liability

To the fullest extent permitted by applicable law, Live4 Wellness shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, or business interruption, arising out of or related to your use of the Services.

Our total liability for any claims relating to the Services shall not exceed one hundred Canadian dollars (CAD $100).

Some jurisdictions do not allow limitations on implied warranties or liability, so the above limitations may not apply to you.

20. Indemnification

You agree to defend, indemnify, and hold harmless Live4 Wellness and its officers, directors, employees, affiliates, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in connection with:

Your violation of these Terms;
Your use of the Services;
Your User Content;
Your violation of any third-party rights.

21. Termination

We reserve the right to suspend or terminate your access to the Services at any time and for any reason, without notice or liability.

Upon termination, your right to use the Services will immediately cease. Sections of these Terms that by their nature should survive termination (including intellectual property rights, disclaimers, and limitations of liability) shall remain in effect.

22. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any disputes, claims, or controversies arising out of or related to these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the British Columbia International Commercial Arbitration Centre. The arbitration shall take place in Vancouver, BC, in English. You waive your right to participate in class action proceedings.

23. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

24. Miscellaneous

These Terms constitute the entire agreement between you and Live4 Wellness regarding use of the Services.
Our failure to enforce any provision of these Terms shall not be a waiver of our rights.
If any provision is held invalid, the remaining provisions shall continue in effect.
These Terms may not be assigned by you without our written consent.
